We have compiled a list of frequently asked questions about Thailand Privilege.
HOW LONG IS THE APPLICATION PROCESS?
The entire application process could take up to 1 month to 3 months.
WHAT IS A RESIDENCE CERTIFICATE AND HOW TO GET IT?
A residence certificate is an official document stating your current home address (permanently or semi-permanently). The document can be issued by either the embassy representing your home country, or by the immigration office in your residence area. Please be reminded that a TM30 receipt is not a residence certificate.
The purpose of the residence certificate is mostly for buying vehicles and/or applying for a driving license in Thailand, and it may also be required for some other legal matters.
To apply for a residence certificate from the embassy, please be informed that requirements and costs may differ depending on the regulations of each embassy. You are strongly advised to contact the embassy directly for a precise information of the fee, required documents, and the procedures.
To apply for a residence certificate from the immigration office, you must have done 90-day reporting at least once. If you have never done a 90-day reporting in your latest entry, you will not be able to apply for a residence certificate from the immigration office.
Required documents for “Residence Certificate”
1.Application form for Residence Certificate in Thailand
2.Original passport (and a copy of the biodata page, current visa, latest entry stamp, and TM.6 Card)
3.Receipt of Notification of 90-day report
4.A copy of your Receipt of Address Notification (TM.30)
5.A copy of your house lease agreement and rental contract where you stay including
-A copy of ID/Passport (if a foreigner) of the landlord
-A copy of the house registration book of the landlord
-A copy of the title deed to confirm who is the owner required if the landlord is not a household
6.One passport-size photo (white background - taken within 6 months)
You can contact the immigration office where you have reported your most current 90-day reporting to apply for a residence certificate. Please note that the processing time takes 10 – 15 working days, and the fees may differ for each immigration office.
After documents are successfully submitted, you will be given a receipt in which you will be required to bring along to pick up the residence certificate. The validity of the residence certificate is 30 days, unless stated otherwise.
Please do not make copies of the residence certificate. Should you need to use another certificate, you will be required to apply for another document.
WHAT IS TM30 ALL ABOUT?
The TM30 notification and its underlying laws are about the obligation of a landlord (housemaster, possessor, or manager) to report the stay of a foreigner (non-Thai national) in his/her property. All foreigners staying in Thailand must be aware of this regulation. The laws about TM30 and the obligation to report a foreigner’s stay have been in place for some time since 1979, but the government has started to enforce it more strictly lately and added this as a requirement to the 90-day reporting and extension of visa.
HOW TO DO TM30?
There are 3 ways to do TM30 Notification.
1.TM30 Notification in person at the immigration office in your residence area
A foreigner staying in Thailand must prepare:
1. a copy of passport (photo page)
2.a copy of the visa page in the passport
3.a copy of the departure card
The landlord should prepare:
1.a copy of the title deed of the property
2.a copy of the rental contract
3.a copy of their National ID card or passport 4. TM30 form (downloadable here)
After the registration or notification, the landlord will get a stamped return slip, which is the lower part of the form (also known as Receipt of Notification). You are strongly advised to always keep this receipt of notification with you. This Receipt of Notification is one of the important documents when going to the Thai Immigration for any matters such as stay permission extension or 90-Day reporting. Please note that if you lost the Receipt of Notification, you will be required to visit the police station to file a police report. You will then need to bring a police report document to the immigration office to issue a new Receipt of Notification. You can take photocopies of the Receipt of Notification and keep only copies of it with you, so that the real Receipt of Notification can be kept in a safe place. Now, foreigners are not required to do TM28 report when they travel to other provinces for a short period of time. Therefore, the Receipt of Notification is valid as long as your current address is the same. However, if you move to other places, you will be required to do a new TM30 Notification within 24 hours of arrival at the new place. Also, if you leave the country, even if you stay at the same address, you will be required to do a new TM30 Notification within 24 hours of arrival when you reenter the country.
2.TM30 Notification through website
at https://extranet.immigration.go.th/fn24online/
3.TM30 Notification through Mobile Application “Section38” (Downloadable only in Thai Region for Both IOS and Android)
At the moment, the Application “Section38” is voted the best and easiest way to do TM30 Notification. For web- based and mobile application reporting, you will be required to create an account first. Once the account is created, you will then be able to proceed with doing TM30 Notification.
WHO SHOULD INFORM?
The responsibility to report the stay of a foreigner belongs to the host: the landlord of a property, the hotel, or the service apartment. In case the foreigner owns his/her room in a condominium, he/she will be required to do the report. Delayed or late reporting of a foreigner can cause a penalization of 800 THB to 1,600 THB per person.

IF MEMBER HOLDS ELITE VISA, CAN MEMBER WORK IN THAILAND?
Elite Visa is categorized as long-term tourist visa, therefore, work is not allowed. However, member can apply for a Non-B visa and work permit to work in Thailand, but this will not put your Thailand Elite membership’s validity on hold. Your Thailand Elite Membership will continue until its expiry date regardless of the type of visas you hold.
According to Thai Immigration Law, a foreigner is allowed to use only one type of visa when entering and staying in Thailand. If a member has been granted a Non-B Visa and wish to use a Non-B visa, member must inform the immigration officer upon entering the country, and the immigration officer will put an arrival stamp in your passport as Non-B.
Please note that if member is using a Non-B visa or other types to enter Thailand, Thailand Privilege Card Co., Ltd. will be unable to provide visa services to members (90-day reporting, stay extension, Transferring visa or arrival stamp into new passport). However, members can use other services as usual.
WHO SHOULD ACT?
Officially and practically, the responsibility to report the stay of a foreigner rests with the host: the landlord of a property, the hotel or the service apartment. Untimely reporting of a foreigner can be penalized with THB 1,600 per person (normally the penalty does not exceed that amount, even if your landlord reports months too late). However, if you are the guest or tenant, you can’t ignore TM30 either: many foreigners report that they need it when going to the Immigration office for a service, such as the 90-day reporting and sometimes even for visa extensions. It still depends on the officer in charge that you're facing, but at such moment that you may find out that your landlord did not report your stay and you will have to explain where you stayed all that time. There is also a risk that you as a tenant (or guest) may be fined instead of the landlord. In some cases, Immigration enforces strictly and demands the return slip of the TM.30 form, in other cases they allow foreigners just to tell them their address and when it's in the system it's okay.
WHEN DO I HAVE TO DO STAY EXTENSION?
Special Entry Visa Holder (SE - Green visa sticker) : Stay extension report must be done every 90 day (as well as 90 day report).
Privilege Entry Visa Holder (Gold visa sticker) : Stay extension report must be done at least once a year, however, it would still require the member to complete a 90 day report in the case if the member stays in Thailand over 90 days consecutively.
Your latest entry stamp/arrival stamp will indicate when to do stay extension.
The immigration will start count day 1 from the entry stamp in your passport. Member is required to extend his/her visa/stay permission before the expiry date stated in the arrival or extension stamp (maximum of 45 days), otherwise member will be considered as 'overstay'.
